• 01/28/05 request for a competency evaluation

  • Prosecutor Braxton requests a competency to stand trial evaluation and that a "special public defender" (SPD) be appointed for me as stand-by counsel
    

    • issued within hours after the press release regarding 01/26/05 demand for restitution for illegal detainment was publicized
      

    • Although Prosecutor Braxton made no mention of this during the hour and a half meeting with him just prior, on 01/28/05 the prosecutor suddenly, upon appearing before the judge, requested that the judge order a "competency to stand trial evaluation" of me.  This was within hours after the 01/28/2005 release of US modern-day slavery advocate demands restitution for illegal detainment, www.prweb.com/releases/2005/1/prweb202165.htm.   When I later asked him why he hadn't mentioned anything to me during our meeting just prior to him making that request, about his intentions to do so, he said that he hadn't considered making the request until the time after our meeting.
      
    • There had already been a decision, relating to this before: see "regarding my competency"  in 07/21/03 - The pre-trial hearing this morning  It becomes clear that decisions made by a previous judge, in a case, does not carry through when the case is, again, turned over to another judge.
      
    • There is reason to believe that, despite that Prosecutor Braxton told me that he'd meet me in the hall outside the courtroom in "a minute," those plans were developed during a lengthy "discussion" with the "public defender" just after our meeting ended.  Additional information regarding the inappropriate presence and behavior of this "public defender" is in the 11/04/04 - regarding my court trial [only slightly modified] v.2 [modified].  It was the second time that this "public defender" had - inappropriately, and perhaps illegally, because I was representing myself, he was violating my right to communicate with the prosecutor, and I had protested his presence due to the inappropriateness of his presence, due to the fact that I was representing myself, and, eventually, due to his repeated disruption of attempted discussions between the prosecutor and myself - sat in on a meeting between myself and the prosecutor.

  • Judge Hillary B. Strackbein states that, upon receipt of the OCE report, she had planned to have me immediately detained

  • judge states that there will now be a competency trial, in addition to and separate from the trial relating to the arrests of 06/16/03 and 10/23/03

  • although I have previously emphatically stated my wish to represent myself, to the judge, and repeatedly to both the prosecutor and and the SPD, judge appoints SPD to represent me in competency trial only

    • neither prosecutor nor SPD make any comments in court, regarding this order

    • I am no longer permitted to communicate directly with the court

  • judge says that I will still be allowed to represent myself in criminal trial

  • when I ask/remind the judge of the motion to dismiss initiated 01/31/05, she said that, because the prosecutor's motion for competency to stand trial evaluation came before that, that has to be resolved before the motion to dismiss

    • when I tell the judge that, if the motion to dismiss were approved, both the motion for competency to stand trial evaluation and the OCE's recommendation would become moot.

      • judge said, "I'll have to think about that.  You can wait until your next court appearance" which is scheduled for 04/01/05 (?)

        • court clerk's office later "maintains" that this was denied on 03/11/05, although no mention of that was made to me, at the time

  • Waterford Police later refuse to provide me with a copy of their report relating to this incident, citing that it was an "unsubstantiated claim"

  • 10/23/03 as I was trying to reconnect with 911, because, for some reason, my cell phone kept cutting out, Terryn sat at the bar and was yelling something over to me like, "What's the matter, Marianne? Are you afraid that aliens are going to abduct you?"
    

    • Groton Police recording in their arrest report for case#2003-25616, "Kiley informed me that LaBrecque was standing on a fireplace platform and was on her cell phone attempting to call 911while yelling something about being abducted by aliens."  This in addition to all of the other falsehoods in that report.

  • 08/09/04 Naholnik submits in a written statement to L&M, that was used as justification for my detainment and, in the hearing 8 days later, both first hand witnesses, Vanboorhies and Willard, admitted was false:

  "MS. LABRECQUE WAS FOUND WALKING THROUGH NEIGHBORS BACKYARD WITH FLASHLIGHT STATING SHE WAS SEARCHING FOR ABDUCTED PEOPLE. MS LABRECQUE FEELS THAT THERE ARE ORGANIZATIONS THAT ARE ABDUCTING PEOPLE AND TAKING THEM TO UNKNOWN PLACES WHERE THEY CONDUCT MEDICAL EXPERIMENTS ON THEM! THESE ABDUCTED PEOPLE ARE THEN HELD IN SLAVERY AT UNKNOWN LOCATIONS. Ms. LABRECQUE USES THE INTERNET AND SENDS E-MAILS TO LOCAL, STATE AND FEDERAL AGENCIES ABOUT THESE ABDUCTIONS."
