Summons and Complaint #1598805 and #1598806
Dear District
Attorney,
Please be advised that I will be representing myself in
proceedings, relating to the above incidents, in accordance
with rights provided under the sixth amendment of the
Constitution of the United State. In doing so, I am asking
you to honor this request for the following:
- Copy of the Bar
Harbor Police Department (BHPD) report regarding the
above incident
- Acceptance of phone
payment by debit/credit card for any associated cost of
such
- Transmittal of this
report to me via email
Upon requesting a copy
of the Bar Harbor Police Department (BHPD) report regarding
the above incident number which resulted in the issuance of
the two summons listed above, I was told by Bar Harbor
Police Department that, instead of being automatically
provided to me for a fee of $7.50, because I was the
defendant in the incident what I was requesting was
considered "discovery" and, thus, must be
processed through your office.
Upon contacting your
office a few days ago, I was informed by "Karen,"
of your office, who would not provide me with her last name,
that the office would not provide me with the report
detailing BHPD's claims regarding the incident until after I
was arraigned. However, upon my explaining that I was
defending myself and needed a copy of the report to prepare
to do so for the pre-arraignment session, she told me that I
could make a request to you for an exception to that
practice, stating that that request, as well, must be sent
by mail. She further advised me that, should the request be
approved, I could only receive the report in person, i.e.,
that it could not be sent to me. Explaining to her that I
did not live near the Bar Harbor area nor in Maine, I said
that I would be requesting an exception to that practice, as
well. Her response was that, should an exception be approved
for me to be sent a copy of the report, the report could
only be sent to me by mail, i.e., not via fax nor email.
Please also be advised that CR-001, Rev. 01/01, dated
05/05/05 [s/b 05/15/05] at 4:50 am at Ellsworth Maine, regarding my
obligations under the Bail Bond relating to this incident,
was signed under extreme duress, rather than freely, by me,
and I object to the "CONDITIONS OF RELEASE." I
particularly object to the "Additional conditions"
which I was to agree to obey, i.e., that "I will not
possess any alcoholic beverages … and will submit to
chemical tests and searches of my person, vehicle and
residence at any time and without probable cause to
determine if I have violated this prohibition." This
condition is a violation of the rights provided to me by the
Constitution of the United State and may also be seen as
extreme additional police harassment as well as an
illustration of the potential abuse of law enforcement and
the legal system to support terrorist activities of
organized crime.
When I stated, when
that clause was read to me and before I signed the
agreement, that I objected to that condition and that it was
unconstitutional, Bail Commissioner Raymond A. Saunders
explained to me that he was ordered to include that by
"the officer." At the time, three guards or
officers were standing behind the desk and behind Mr.
Saunders. I heard a sound behind me, as I stood on the
opposite side of the desk from Mr. Saunders. When I turned
to look in back of me, I learned that three to five guards
or officers were standing in back of me. I asked no further
questions but, before signing said something like, "I
guess I just better sign whatever you give me if I want to
get out of here."
Further, due to the
need for me to currently be "in hiding" from
members of organized crime against any further possible
retaliation against me, I have not and do not agree to
"advise the court … of any change in my address or
telephone number, and do not waive extradition to the
"State of Maine from … any other jurisdiction
whatsoever, for prosecution… ." The pattern of
subject suspected crime members' suspected abuse, coercion
and/or infiltration of law enforcement and the legal system
to protect and foster their criminal activities points to
the possibility that they could use these "CONDITIONS
OF RELEASE" for their own purposes, as well.
In addition to the arresting officer, Eric McLaughlin,
someone who claimed to be a Bar Harbor Police Senior Officer
by the name of Timothy Bland also appeared at the scene and
was the person directing the arrest and carrying out the
booking procedures. "Timothy Bland" refused to
provide me with any form of identification, nor even a Bar
Harbor Police business card similar to the one Officer
McLaughlin had given me. I pointed this out to "Timothy
Bland," in response to his refusal, telling him that
newspapers have reported numerous incidents, in my local
area and elsewhere, of people illegally posing as police
officers and, in my own experience, there have also been
incidents that suggest that off-duty police officers have
illegally taken part in incidents. He accused me on not
"focusing" on my arrest. I told him that this was
an illegal arrest. "Timothy [Bland]" said that he
had a badge and a uniform therefore, "of course"
he was an officer. Mr. Saunders, the Bail Commissioner, did
not indicate if "Timothy Bland" was "the
officer" who, he said, ordered my "CONDITIONS OF
RELEASE."
Please work with the
Bail Commissioner and Bar Harbor Chief of Police Nathan
Young, and/or whoever else must be involved, in preparing
and emailing me more appropriate "CONDITIONS OF
RELEASE" to review and sign so that I may re-enter the
state of Maine without fear of being illegally detained and
searched without probable cause.
Please also be advised that I am also requesting an
indefinite continuance of this case in Maine, due to my
continuing court cases in Connecticut relating to arrests of
me on 6/16/03 and 10/23/03, and to which there are strong
implications that this case in Maine is not only related,
but was purposely orchestrated to negatively impact. (See
third attachment to this letter) My letter of today to Bar
Harbor Police Department Chief of Police Nathan Young
provides additional information regarding this aspect. (See
fourth attachment)
Please see the first and
second attachments for additional
information regarding the status of these Connecticut court
cases. In addition, two weeks ago, on 7/15/05, in a
conversation with a staff member of CT Superior Court's
Clerks office, I was told that there was no record and no
knowledge, by that office, that Judge Hillary B. Strackbein
had received my 5/17/05 letter to
her, the first attachment
included here, even though that letter had been faxed to
that office and both my automated fax records and an
implication made by the Connecticut Superior Court, G.A. 10
Special Public Defender Beth Hogan, indicates that the
letter had been received by the Court's Clerks office. It is
not to be assumed that the letter was properly forwarded to
the Judge, however, nor have I received any response from
the Judge that would indicate that it had.
In that 7/15/05
conversation, additional information was given to me, by
that office, of developments that are either inconsistent
with normal practice of that court or contrary to what was
told to me by the Judge. The developments relayed to me are
also irrational and possibly illegal. For that reason, I
must await word from proper authorities, regarding the
status of these cases, and will be pursuing this. I was also
told by that office that Prosecutor Braxton is prohibited
from responding to my 6/3/05 letter to
him, which is the
second attachment to this letter.
